Terms and Conditions of Rheinwerk Publishing, Inc. for Events and Videos
The following terms and conditions govern the use of Rheinwerk Publishing’s (hereafter: we, our) event and video products by the customer associated users (collectively: you).
1. General
a. We offer you the opportunity to participate in online courses as online events (hereafter referred to as "events") exclusively on the basis of these Terms and Conditions in the version valid at the time of booking.
b. The information on the events on our website serves as a general description of the services. We provide it to the best of our knowledge and belief, but offer no guarantees. There are no guaranteed features.
c. The presentation of the events on the event websites is not a legally binding offer to conclude a contract. A contract is only concluded when we accept your order.
d. You do not book the event directly on our website. The technical booking and payment processing and the administration of tickets or documents are carried out by our service partner rami.io GmbH with its product pretix (www.pretix.eu).
2. Registration
Registration for an event takes place in several steps:
1. On our event website, in our web shop, on our partner's event page, or via other linked online offers (e.g., Facebook, Instagram, or LinkedIn), you will receive all necessary information about your event, including the content, price, date, and time.
2. For purchasing the ticket, you will be redirected to the pretix ticket shop. Ticket orders at pretix do not require an account. For information on the use of your data as part of the pretix ordering process, please refer to pretix's data protection guidelines.
3. In the case of bulk orders, you have to provide information on the individual ticket owners.
4. To complete the purchase, you must click on "Buy now" after checking your order details. By placing your order, you are bindingly declaring that you want to purchase the event ticket.
5. As soon as the order has been processed, you will receive an order confirmation email from pretix. In addition to the invoice, this email also contains more detailed information about our event and links to the terms of use and data protection provisions that apply between you and pretix.
6. If you have purchased access to a video, you will only receive the access code for the digital product after the event, as soon as the video content is available.
7. If you have purchased a ticket for an event, you will receive an email with your access link several days prior to the event. Please make sure to enter an email address for each individual participant in the registration process so that the respective participant also receives their access code.
3. Conclusion of Contract and Payment Conditions
a. Your registration becomes legally binding through the order confirmation email.
b. The ticket prices stated on our event websites are net prices, plus statutory sales tax, and apply per person and event date.
c. Payment of the purchase price is due immediately after conclusion of the contract. You can choose between the payment options offered by pretix. Refunds will only be made to the payment method you originally chose.
d. If you purchase on invoice, we reserve the right to cancel the ticket if no payment has been made to our specified bank account by 12 p.m. on the last business day before the event.
5. Services and Conditions of Participation
a. To participate in our events, you must be of legal age. This applies to every ticket category, including the video ticket. If you are not of legal age, we must exclude you from our events. In this case, the purchase price will not be refunded.
b. Partial participation in the event does not entitle you to a reduction in the participation fee.
c. In exceptional cases, we reserve the right to replace announced speakers with others and to make changes to the event program (e.g., content, dates) while maintaining the overall character of the event. We also expressly reserve the right to make price changes, technical changes, errors, and misprints.
d. If any disruptions to the event occur, we undertake to do everything reasonable to help resolve or limit the disruption. Participants are not entitled to a refund due to merely temporary disruptions to an online event.
6. Delivery and Availability of Digital Products
a. After ordering and paying for a ticket for an online event or a video, you will receive a personal access code that allows you to participate in the booked event via streaming or to use the ordered content on a video portal.
b. The access code for an online event (live content) will be made available to you several days before the start of the event.
c. The access code will be sent to you by email. With the access code, you will receive detailed information about which video portal the content is available on and how you can use the content conveniently.
d. As a rule, you have unlimited time to exercise your right to use the digital product. However, copyright, technical, or economic reasons may make it necessary to no longer keep a digital product available. Therefore, the following applies to a video ticket: We guarantee you a usage period of 12 (twelve) months from receipt of the access code.
e. Within the guaranteed period, you can use the digital product you have purchased as often as you like and without time restrictions.
7. Copyrights and Terms of Use
a. All our products are protected by copyright. As a user, you agree to recognize and comply with copyrights.
b. When you purchase a ticket for digital content (e.g., video ticket, online events), you do not acquire ownership. You receive the simple, time-limited, and non-transferable right to use the digital product for personal use.
A time limit on the right of use only arises insofar as the guarantee for online retrieval according to Section 6d of these Terms and Conditions is limited from receipt of the access code.
You are entitled to use the digital product for personal purposes. Passing it on to third parties is not permitted, neither in whole nor in part. Nor is it permitted to hand over the display device to third parties in order to enable them to use the digital product. In particular, public reproduction, placing the digital product on the Internet or in a company network, lending, reselling, and any other type of use for commercial purposes is not permitted.
The copyright notices, digital signatures, trademarks, and other legal reservations contained in the digital product may not be edited or removed. In addition, the following applies: The access code for the use of the digital content and the right of use granted with it are personally bound to the first purchaser or first user. The separate passing on of the access code is not permitted. Handing over or temporarily transferring your access to the video portal and the digital products available there is also expressly prohibited.
c. If we have reason to believe that there is unauthorized or improper use of our digital offering or a violation of the terms of use, we have the right to, among other things, request proof of purchase from the customer on a case-by-case basis, change the access code, block access partially or completely, or prohibit further use of digital products that have already been downloaded.
8. Cancellation, Rebooking, Force Majeure, and Information on the Right of Withdrawal
The following conditions apply to the cancellation of your registration:
a. Tickets purchased for digital content cannot be returned or exchanged. Participants cannot make cancellations.
b. You can nominate a replacement participant free of charge up to 7 days before the event date. This is no longer possible from 7 days before the start of the event.
c. Requests for replacing a participant must always be made in writing. Send your request via email to support@rheinwerk-publishing.com. Alternatively, you can contact us via the link provided at pretix. Regardless of the contact method, we will process your request within 5 business days.
d. If you are unable to attend the event due to proven illness and inform us of this in writing, a voucher for the participation fee paid will be issued after you have sent documentation from a medical professional. This can be redeemed for all open events of Rheinwerk Publishing Inc. within a period of three years. In this case, there is no cancellation fee. The voucher is created for the equivalent value of the booked ticket. You will not receive a subsequent refund of the difference for the conversion to a video ticket. Please note that the certificate must be received by us no later than 7 days after the end of the event. If we receive it later, the ticket booked for the already-completed event and not redeemed due to illness will expire definitively, and you will no longer be entitled to a voucher for open events of Rheinwerk Publishing, Inc. or to conversion to a video ticket.
e If the event cannot be held due to force majeure, because speakers are unable to attend, or because the number of participants is too low, all participants will be informed immediately. Cancellation due to insufficient number of participants will occur at least 5 days before the event for online events. The event fee will be refunded in full in all cases.
f. A claim for loss of work is excluded unless such costs arise due to grossly negligent or intentional behavior on the part of Rheinwerk Publishing, Inc.
g. The offers described on the organizer's website do not apply to members of parties or other persons who represent racist and extremist positions or who help to spread them and thus call into question the principle that all people are to be respected as individuals with equal dignity and equal rights. This principle is a consensus that is constitutive in a democratic society based on human rights and for the constitutional order. It is non-negotiable. The organizer is committed to this principle, and to protect other participants in the event who could potentially be directly affected by racism or extremism. If there is reasonable suspicion, the organizer reserves the right to withdraw from the purchase contract.
10. Liability and Warranty
a. The events are prepared and carried out by Rheinwerk Publishing Inc. and its speakers with the greatest care. However, we accept no liability for the accuracy, timeliness, and completeness of the event content and documents.
b. We accept no liability for the event not taking place unless we are responsible for this. In particular, we are not liable for the cancellation or termination of the event unless we are responsible for this due to intent or gross negligence.
c. Before purchasing a ticket for an online event or a video ticket, the buyer is responsible for checking whether the device and internet connection they have chosen are suitable for using the product. If this turns out not to be the case, this is not a defect for which we are responsible. On request, we will inform you about the system requirements for using the video content on the video portal selected for this purpose; as a rule, it is sufficient to have an up-to-date browser and an up-to-date operating system installed on the desired device.
d. We do not guarantee that the video portal (video ticket) or the digital products (events) will be accessible at all times. Rather, we expressly point out that access to our online services may be temporarily unavailable or only possible to a limited extent (e.g., due to maintenance work, security measures or disruptions, and problems over which we have no influence). The temporary, short-term unavailability of the video portal or the unavailability of a digital product does not entitle the customer to price reductions, withdrawal, or claims for damages.
e. In the event of slight negligence, we are only liable for breaches of essential contractual (cardinal) obligations, meaning those obligations that concern the proper execution of the contract and on whose compliance the contractual partner can regularly rely. In this case, the scope of liability is limited to the typically occurring, foreseeable damage. There is no liability for indirect damage, consequential damage, or lost profits. The limitation of liability also applies in the event of the fault of a legal representative or vicarious agent of ours.
f. In all other respects, our pre-contractual, contractual, and non-contractual liability is limited to intent and gross negligence. In the event of grossly negligent fault of a vicarious agent of ours, any compensation to be paid is limited to the typically occurring, foreseeable damage. The limitation of liability for gross negligence on the part of a simple vicarious agent does not apply if the damage is based on a breach of essential contractual (cardinal) obligations.
g. Rheinwerk Publishing, Inc. will provide the participant with proper information and instructions during the event through its staff, and will design the event environment in accordance with the legal requirements.
11. Data Privacy
We assure you that the processing of your personal data will be carried out in accordance with the applicable statutory provisions of data protection law, in particular the General Data Protection Regulation (GDPR).

12. Final Provisions
The place of performance and jurisdiction for all disputes is Boston, Massachusetts, provided the customer is a merchant or a legal entity.
The law of the Commonwealth of Massachusetts applies, excluding the UN Convention on Contracts for the International Sale of Goods.
